The railroad lawyers raised the question to determine the ola of detectives and special polit icemen try Tiréatms. “The-1aw,*Morris ‘said, .permits- rail- roads to employ their own peace of- ficers and another section grants to Peace officers the right to carry arms. Still another section, however, makes any person “other than a pub- lic officer,” Mable to prosecution if he carries arms except in the prosecu- tion of or to effect a lawful and legi- timate purpose. Since railway police are not public officers, their carrying arms is limited to an effort to “ef- fect a lawful or legitimate purpose.” ‘Viewing the statutes from all angles Morris said, it appears that rail- way police have the right to bear arms in their work of protecting rail- road property and maintaining order on railroad premises but should they carry weapons while not so engaged they would be subject to prosecution. * SUMMONS State of North Dakota, County of Bur- ae Bistrict Court, Fourth Judicial rict. ark District of the e City of Bismarck, “North Dakot: nieipal curpora- , Plaintiff, vs. Jobn J.
