| aman DRIVE POSTPONED 0 FALL Recently Appointed State Com- mission Elects Dr. Andrew Carr Chairman The diphtheria commission recent- ly appointed by Governor George F. Shafer has organized by electing Dr. | Andrew Carr, Sr., president-elect of the State Medical society, chairman, and Dr. J. D. Jungman, secretary. The commission decided that this | was not a favorable time for launch- ing into its work, which is the eradi- cation of diphtheria in North Dakota, as it has virtually been accomplished in New York. Vacations will soon be- gin and there will be other obstacles to undertaking the drive against the disease. Active work, therefore, in- cluding raising of funds, will be post- poned until fall. The commission is using part of the plan of Dr. Seymour, minister of health in Canada. His program in- cludes the extermination of smallpox, typhoid fever, diphtheria and scar- let fever. The members of the commission in- clude Senator Frank Hyland, Devils Lake; Mrs. Inga Norstog, McKenzie county superintendent of schools; Father Slag, St. Mary's parish, Bis- marck; Mrs. Lillian Lillibridge, ad- viser to the Rainbow Girls organiza- tions, Dickinson; T. O. Kraabel, state veterans service commissioner, Far- go; Dr. Carr, the chairman, Minot; Miss Grace DeLong, 4-H club special- ist from the Agricultural college, Far- go; Mrs. A. E. LIQUOR AGAIN HELD VALIDLY UNDER BAN State Supreme Court Rules Pro- scribing Possession Not Unconstitutional ‘The state supreme court again is on record to the effect that the state law making it a felony to possess intoxi- cating liquor is not unconstitutional. Gunder Ligarden appealed from conviction on a charge of possessing liquor as a second offense, filed against him in the Divide county dis- trict court. He contended that the federal law does not make the mere possession of liquor a crime and hence the state law cannot do so. Incidentally, he cited various Biblical Passages to support his theory that prohibtion is wrong in principle, any- | way. The court made no comment on the Biblical quotations but held that the federal law is not binding on the state unless the state wishes to do some- thing in opposition to it. The state can go farther than the federal gov- ernment in the way of passing pro- hibition laws as it cares to do or as its own constitution will permit, the court held.
