J. Ermatinger, its former + Secretary, will be made by F. E. Tu- pe fund manager, he said here to- jay. The bonding board ts expected to meet within the next few days to pass on the matter. Its members are the insurance commissioner, bank ex- aminer and attorney general. Tunell said his rejection of the claim was based on two points; one that the amount of the alleged short- age is not definitely fixed in the claim; the other that the highway commission did not file notice of claim within 60 days after it had knowledge of the alleged shortage, as required by law. ‘ The highway department based its claim against Ermatinger’s bond for $1,644.89 on estimates of loss made by the state bank examiner in his re- port of the examination of the high- way department's affairs. The bank examiner and O. B, Lund, auditor for the state board of audi- tors. made identical reports on the matter.
