Shipley and Gus Kaline, Bi:merck men charged with carrying loaded guns ona game refuge, has been dis- charged by J. E. Campbell, Mandan Police magistrate. The magistrate ruled that the game refuge, on which they are charged with carrying guns, was not proper- ly marked. The refuge is on the Heart River 12 miles southwest of Mandan. The men were arrested Oct. 13 and a complaint against them was sworn out Oct. 21 by R. Kinzer, state game warden. BARCHENGER SENTENCE S8US- PENDED A suspended sentence of two years was meted out yesterday to Arthur Barchenger, 20, New Salem, who had Pleaded guilty to a charge of third degree forgery in Norton county dis- trict court. Sentence was made by Judge H. L. Berry. What name will be given to Mr. Kennelly has not yet been decided by the Indians, Two Bears says. The program is being sponsored by the Albert Grass post of the Ameri- can Legion, Cannon Ball, which is | composed entirely of Indians. Morton Court Begins First Criminal Case Trial of Jack Myer on a statutory count was begun in Morton county district court shortly before noon to- day, with Judge Thomas H. Pugh, Dickinson, presiding. Four men entered pleas of not guilty to criminal charges as court was re- sumed at 9 a.m. today. They were B. L. Heath, charged with extortion; Pat McCleary, grand larceny; Charlie Bower, facing a count of shooting with intent to Rill; and Lorenz Stumpf, maintaining a common nuisance.
