Shores charged officials of the Dakota Montana Oil company with fraud in a stock deal he stated @ cause of action sufficient to war- rant a trial in the district court, the supreme court held today. Its actton affirms an order of the Ward coun- ty district court in denying the de- ‘| fendants’ demurrer to the complaint. Shores charged that he owned $42,- 000 worth of stock in the company that he turned it over to com- pany officials with the under- standing that he was to receive other stock for it but that he never received the new stock. The defendants fil @ demurrer contending that he hi no legal cause for action but the dis- trict court and supreme court dis- agreed. The case was remanded to the Ward county district court for ac- tion. In the case of Margaret Hedine vs. Theodore Meyer, August P.
