asa WEDNESDAY, DECEMBER 28, 1927 GUARDS ARE BACK ON DUTY IN CAPITOL Oklahoma Senate Announces It-Will Meet Despite Court Injunction Oklahoma City, Dec. 28.—(?)—The national guard was ordered back to duty in the state capitol building this morning when senate leaders defi- nitely announced they would attempt to meet there as a court of impeach- ment in defiance of an injunction ob- tain Gpvernor Henry 8. John- the senate had decided to convene at @ secret caucus called at a local hotel shortly after midnight. He declared that if the soldiers denied them use of the senate chamber, they, would meet elsewhere. id Senafoy Fidler announced that 22 secret caucus. He said they decided to vote on an order to suspend Gov- ernor Johnston immediately after convening as a court of impeach- ment, He said the senators would meet at the capitol at 10 a. m. Senate Superior to Courts After voting on the suspension of tke governor, Senator Fidler said is- suance of a formal call for a special session of the legislature would be considered. The senate then would review several court decisions ad- verse to the contention of legislators that they have a right to call a spe- cial session. The senate, if legally convened, is superior to other state courts. epresentative Tom Johnson, one of the leaders in the impeachment proceedings, declared a majortiy of the lower house were here and ready to conform to orders issued by the senate. Approximately 60 guardsmen un- der the command of Major Abe Kerskowitz were mobilized and moved intg the capitol basement. The court order prohibiting as- sembly of the senate called upon the sheriff of Oklahoma county to en- force the temporary injunction and required the governor to lend any assistance which might be neces- sary. Thompson told the education section of the American Association for the Advancement of Science today. Mr. Thompson is associate professor of education at Colgate university. Professor Thompson described the results of a statistical study of the classes of 1926, 1927, 1928 and 1929 in the Colgate college of arts. He said that intelligence tests and scholastic marks given by the college indicated that “the freshman year is the best year on the campus in point of correlation of intelligence with scholarship.” “This,” he said, “raises a new question as to whether the American college campus fosters the intellect- ual life in accordance with the com- monly stated purposes of a liberal arts college.
