Thiele from a life imprisonment term was begun by Willlam Langer, counse. for the accused slayer of Nels Romer, Mandan police chief. The affidavit was filed before State’s Attorney Kelsch filed his criminal information charging Thiele with it degree murder. It is Lung- er’s theory that, as a result of this, Judge Berry must certify the affida- vit to the supreme court, which should then appoint a new judge to sit tn the case. The prosecution, however, contends that the affidavit was prematurely filed, since no criminal information had yet been filed, and therefore of no weight, but declared that it would y e the matter to the supreme court decide, The information, Kelsch will probably be filed late to- Judge Berry, who, if the theory of the prosecution is correct, has the privilege of ca!ling in another judge instead of submitting the matter to the supreme court, stated that he plans to take no action in the matier until the court decision is received. When questioned this morning, Langer was not sure #s to whether a change of venue would be _ taken from Morton county, although he ex- pects to make his decision shortly. State’s Attorney C, F.
