Thoresen and Judge Hanley indicat- ed immediately that the case will be appealed to the state supreme eourt with the request that an early hear- | ing be granted. The opinion has been expressed that all justices of the su- be disqualified from sitting on the case, inasmuch as each was affected in one way or another by the reassessment, and it will prob- bly be necesary to call in five dis- t judges to hear the arguments. Judge Coffey stated last night that the effect of the decision will be to spreading the reassessment upon the tax books of the county and will put the original ass@ssment in force. No Further Delay In Tax Collections In a si ment Tax Commissioner Thoresen said final decision as to whether or not appeal will be made within the next few days. In any event no attempt will be made to further hold up the collection of taxes in Burleigh county, already delayed a month. The appeal, if taken, will be designed to determine whether or not the law is constitu- tional, “I rgret that the reassessment as ‘ked out on minor technical- ity,” said Thoresen, “It as sorely needed to correct gross injusti existing over a period of years which will continue until adjustments are made by some disinterested party.” He said he believed the reassess- ment attempt here would have a beneficial effect not only in Bis- marck but in other taxing districts by calling the attention of the peo- ple to the importance of proper val- uation of property for taxing pur- poses.
