ASK FRANCHISE BE REFERRED TO ELECTORS A petition demanding that the franchise granted the Hughes Elec- [trie Company by the Board of City Commissione their mecting held two weeks ago be referred to the electors in accordance with the pro- visions of law was filed late yester- afternoon with the city auditor. Tb were Abt” inatite Sniose lof iene are residents of the south side of the railway track. Those behind the circulation of the petition for the reference of the franchise contend that the emergen- cy clause which was appended to the published ordinance at that meeting is not effective, on two grounds. First, because no real emergency ex- isted due to the fact that the pres- ent franchise of the Electric Com- pany does not expire until next Au- gust, and the second ground is that scaiuibionaes the emergency clause was not read! twice at the meeting at which it was passed. The petition will be presented to the Board of City Commissioners at their next meeting on Monday night for action. It is probable that some litigation will result from the filing of the petition, Should the city commissioners refuse to submit. the matter to the voters then mandamus proceedings will doubtless be insti- tuted to compel them to do so. On the other hand, if the Board of City Commissioners determine to submit the matter to the electors, then pro- bably an injunction suit ‘will be brought to enjoin the submission. In this manner the matter of the correctness of the procedure and the validity of the emergeney sec- tion will be tested in the courts. At any rate the voters will not have the matter up for their deter- mination at the next city’ election to be held on April 7th. More than 1,500,000 people visited the national parks of the United States last year. =a rdow Ask to see style APEX if you want a hat that’s everything a bonnet should be in style—comes in rich browns, steels and pearl, It's only one of the many new spring Gordons.
