Bergh, cashier and general manager of the bank, seeking the loan and Bergh, who previously had transacted busi- ness with Jenkins, made arrange-| ments for the Chicago man to furnish the money. The 4,500 was forwarded to Bergh with instructions that it be held in trust until all titles to the land had been cleared up. Bergh, however, the testimony showed, sent the money which was in the form of two checks to a St. Paul bank for collection which was done and the money was returned to the Towner bank which shortly thereafter was closed. Bergh subsequently was arrested and char- ged with numerous violations of the} national banking laws, to which he} pleaded guilty and was sentenced to, Leavenworth penitentiary where he was confined at the time he died a little more than a year ago. The theory of the plaintiff's case was that Bergh was acting in the \pacity of an agent for Dokken in |the securing of the loan ang that j consequently Dokken could be held liable for the 4,500.
