CREAMERY TAX INVALID, CLAIM: OF CREAMERIES Answer Suit Broug Brought by State Commissioner to Enforce | Payment of Tax - Declaring the state experimenta creamery law to be unconstitutiona and asserting that funds were squan dered in the Werner creamery oper ated by the commissioner of agricui ture and labor, the Northern Produc Company, of Bismarck, representin, the creameries of the state subject tc tax, has filed answer to the suit insti tuted by Commissioner of Agricultur: and Labor J, A, Kitchen to ‘compe them to pay the tax. The creamery opposes the state’: suit to collect the tax, which was ley ied by the legislature on butter fa production to provide funds wit, which to operate an experimenta creamery, on the following grounds. That “while the said chapter 149 0 said session Jaws is ostensibly for thc Purpose of managing and operating < state experimental creamery the pri mary purpose as specifically expresse¢ in said ehapter 149, js the buying manufacturing, grading, storing anc marketing of dairy products and by-pro ducts; that by reason thereof the sai¢ chapter 149 is unconstitutional.” That the law grants special privi leges and immunity to the dairy indus try of the state, makes unreasonable classifications which arbitrarily and oppressively discriminate ‘against the ‘business of the defendant and deprive the defendant of equal’protection of the law. It further opposes the collecting of the tax “for the reason and upon the ground that no experimental work has ever been or is now being condugted by the plaintiff; that for a short time prior to the last day of January, 1921, the commissioner of agriculture and labor did operate a creamery in the western part of this state but that the same .was operated solely aS a com- petitive private industry, was of no Reneilt to the dairy industry of this gc Or to the industry or business in “a ich this defendant is engaged and that while the said’ creamery closes it: doors long ipricr to tie last day of July, 121, after having fully demon- strated its inability to promote either « of the said industries aforementioned, such funds as had theretofore been as- sessed and collected under and by vir- tue of said chapter 149 were squander- ed and wasted nearly the whole of said year 1921.” : The case probably will be heard in the Burleigh county district court soon.
