HALTED All was quiet and serene at the Bank of North Dakota this morning. ‘There was rather a heated session there last night, when Governor Frazier and com- missioner of Agriculture John N, Hagen, as members of the industrial commission, foregathered with Man- ager J, R. Waters and Director Gen- eral F. W. Cathro for the’ purpose of discovering “where they were at,” There was a long and interesting conference ont of which was evolved a letter signed by Director General F. W. Cathro and given the Courier-News at Fargo for advance publication. When Deputy Auditor Woerner with his corps of accountants presented him- self at the Bank of*North Dakota this morning to continue the examination ordered yesterday by Attorney General Lange! fr. Woerner was presented with this letter, which is as follows: CATRO'S LETTER October 7, 1919. Mr. C. R. Kositzky, State Auditor, Bismarck, North Dakota, Dear Sir: Due to the false statement to the ef- fect that the Bank. of North Dakota was carrying $325,000 of the Scandi- nayian-American Bank’s' paper, we per- mitted you to examine the rediscounty and bills receivable to satisfy yourself of the falseity of the charge. You com- pleted that examination on Monday af+ ternoon and discovered none of the items you came here to find. There are reasons why your exami- nation of the Bank of North Dakota should not continue, First, you have no legal authority to examine the insti- tution. But, principally, the Bank of North Dakota recog that’ its con- }fidential relations with its customers must be protected. Furthermore, the Bank of North Dakota has undertaken (fo keep clear of political entanglements and has adopted a policy in line there- with. GUARD CHASED AWAY Carl Eliason, a former state house janitor, and one of the two men ap- pointed by State Auditor Kositzky to guard tle bank, was sitting in his car in front of the bank building last night when Manager J. R. Waters discovered him and ordered him to move on. Elin- son: moved and reported to Auditor Kositzky, who then procured for his two guards—Ellason and J. H. O’Brien —commissions as special policemen. Eliason then returned to the bank cor- ner, but he was ordered by the bank officials to take up his stand on the opposite side of the street, which he did. There were no casualties on this sector, The bank was open until a late hour last night. A Tribune reporter was in- vited: to inspect the bank vaults: to see for himself that they had not been sealed up, a8 the state auditor had pre- dicted they would be. It was stated, however, that seals had been applied but that they had slipped off. FOR PROTECTION OF CLIENTS Director General Cathro, in an in- formel statement this morning, de- clared he had halted Kositzky’s exami- nation solely for the protection of’ the bani clients. He declared a bank’s relation with its clients to be as con- fidential as those between a physician and his patient, and declared that in justice to the bank’s patrons it could not violate these confidences by open- ing its books for examination whenever a demand was made. He stated ‘that the bank had permitted Kositzky to ex- amine rediscounts and bills receivabie to prove that it had nothing to fear and that further than that it did not feel justified in permitting Kositzky to go. PAPER WAS SENT HERE It is reported that some time’ ago the Seandinavian-American bank © did send the Bank of North Dakota a large amount of securities upon which it ! pplication for a loan. These , it is said, remained in’ the pe ion of the Bank of North: Da- kota for some time, but they weré not accepted as the basis of a loan, ‘and they finally were recalled by the Scan- n-American, It is said that it arbon copy of a letter which Cas! Sherman of the Scandinavian- 4 ican bank wrote the Bank’ of North Dakota in connection with the transaction that Temporary Receiver Haldorson discovered in the files of the Fargo institution, and that this prompted the examination which Attor- ney General Langer directed made yes- terday.
