Following N. P. Ry. Co. v. Rich- land county, 28 N. D. 172, it is held that a special assessment for a local drain upon a Railway right of way: if benefited, is not violative of the 14th amendment, or the Commerce Clause of the federal constitution. Action to determine adverse claims involving a special assessment for the construction of an intercounty drain. Appeal from judgment of dis- trict court, Sargent county, Allen, J., entered for the defendant for $3,- 189.70 and interest. Affirmed. Opinion of the court by Bronson, J. Christianson, Ch.
