City Commissioner Best brought matter up at the weekly commis- sion meeting last evening and intro- duced a resolution providing that the city of Bismarck shall compel the Bis- marck Gac Co., to sell gas in conform- ity with the terms of its franchise. Judge Grace in a dissenting opinion holds to the contrary, contending that the nominations of no party are closed until the vote of all parties has been | canvassed and the returns duly certi-| fied. The plaintiffs and appellants in this action were Anthony Walton, league floor leader in the last assembly; J. E. Erb and Bert Solberg, unsuccess- ful league candidates for the repub- lican nomination for members, of the. house ‘of representatives from Ward county. The defendants were Ben Olson, Guy Humphries, O. J. Cleven and George Reishus, the successful in- dependent candidates for the repub- lican legislative nominations. The real merits of the contest, which lay in a claim-that registration is obligatory under the primary election systea: and that 1,000 Minot voters had failed to register, but swore in their votes on primary election day, and that their votes should not be counter, was not ruled upon in either court. Walton. who ‘had the highest vote} among the league candidates, was but 74 behind his ‘successful independent} opponent. In retaliation for the alleged tight- ening up of farm loans in North Da- kota, which the league claims is a political blow aimed at the Nonparti- san organization, drastic legislation affecting the business of foreign life insurance companies in this state may be expected of the next general as- sembly, says an informant, who is on the know, and whose tips have been found reliable. Foreien life insurance companies hold a large number of the farm mortgages in this state, and it is claimed that they have recently adopt- ed a hostile policy toward investment in North Dakota, owing, the league claims, to Nonpartisan control of state affairs.
