This left $21.70, which after deducting the actual expenses of the trip, $16.37, left $5.33 as the net compensation to the sheriff’s office. The state law allows traveling expenses for each mile actu- ally and necessarily traveled at 10 cents a mile and livery charges and every fee collected was in accordance with this law. Therefore, Dr. MacLachlan either deliberately or unknow- ingly stated an absolute falsehood. Instead of the exorbitant fees claimed. to be collected by Dr. MacLachlan, namely $254, 00, there was only collected $40.90. J. P.
