Supreme Court Withdraws Action One of North Dakota's famous}{ “snoose” cases, won in the supreme) court of this state by former Attorney | General Linde and appealed by the| defendant, C. J. Olson, representing the Weyman-Bruton Co., to the su- preme court of the United States, has been withdrawn, according to a notice received here today. The state brought action to restrain the sale of the Weyman-Bruton Co.'s! “Right Cut” on the contention that it! was not honest-to-goodness fine cut chewin’, as advertised, but Old Man Snuff in disguise. The supreme court found that the state had a right to) prohibit the sale of snuff, and that! “Right Cut” might come under the general snuff category. The Weyman- Bruton Co. then appealed to the na- tion’s highest tribunal, from which it now has withdrawn this action. There is pending in the United States supreme court, however, an- other “snuff” case involving “Right Cut,” in which the Weyman-Bruton Co. has obtained an injunction re- straining Dr. E. F. Ladd, the attorney | general or anyone else concerned from saying uncomplimentary things of its product until the high bench passes on the question of whether “Right Cut” is chewing tobacco or snuffing to- bacco. OFFICIAL PROCEEDINGS OF CITY COMMISION, OCTOBER 22, 1917. The city commission met in regular session. There was present Commis- sioners Bertsch, Best, Kirk and Presi- dent Lucas. The minutes of the meet- ing held Octoder 15th, 1917, were read and approved. No one appearing to protest against the assessment for sidewalks constructed along the east side of blocks 6 and 7 Northern Paci- fic Addition to the city of Bismarck the same was approved by the com- mission. No one appearing to protest against the assessment for sidewalks constructed along the west side of lots 18 to 24 both inclusive in Block 77 Williams Survey in the city of Bis- marck, the same was approved by the commission. The City commissioners acting for the city of ‘Bismarck accept- ed a strip of land twenty feet wide} running from north to south in the center of Block 106 Original Plat to the city of Bismarck, to be used as a public alley. Sidewalks were ord- ered constructed on the north side of lot 1, block 52, Original Plat to city of Bismarck, North Dakota. Commis- missioner Lest made a verval report concerning devices for the cleaning of sewers. He was given authority to go ahead and have some of these cleaners made and to try them out. The report of the chief of police for the month of September, 1917, was read, received and filed. This report showed _ that 30 arrests had been made. The bride gave her age as 15 years. Buys Large Dairy Farm.—Mrs. J. W. Moran, who formerly resided on the James McDonald farm, has purchased a half-section from Dr. T. M. McLach- lan southeast of this city and will con duct a large dairy. Mrs. Moran has christened the farm “Sunnybrook Dairy Farm.” The place was well equipped for a modern dairy with a large cement creamery, when pur: chased but .Mrs. Moran will add a large dairy barn 36x80, with all the modern equipments.
