Judge McNenny in a Belle Fourche irrigation project case holds that homestead lands are sub- ject to taxation prior to the issuance of title by the government, and that the homesteader is responsible for the payment of taxes on his interest in the estate. Many homesteaders in Sioux county onthat portion of the reservation opened in 1909 are sub- ject to tax under this ruling.
