QUIRING HOTELS AND RES- TAURANTS TO PAY FOR THE REMOVAL OF THEIR GARBAGE. Be It Ordained by the Board of City Commissioners of the City of Bis- marck, North Dakota; ‘Sec. 1. The City Auditor shall be- fore May 1st, each year, advertise-for bids for the removal of garbage from .all residences and business proper- ties in the city of Bismarck to the city dump grounds, said garbage to be removed at least once every two weeks and not more than once a day where required. Said contract shall be let to the lowest ‘bidder, who shall fur- nish bond in such sum as the Board of City Commissioners shall require. Said contract shall run from May Ist to November 1st of each and every year and.said contract shall be let for one season at a tim&only. Bids shall be made on the basis of a certain Jump sum monthly. 3 Section 2. The costs for the re- moval of said garbage under this or- | dinance shall be paid out of the ‘gen- eral fund, provided, that all hotels and restaurants shall pay the sum of $1.00 for each and every load of garbage removed after the first two loads per month and provided further that noth- ing in this ordinance @hall prevent providing for the removal of their own garbage. The contractor under this ordinance shall be paid monthly for removing said garbage, and shall remove said garbage in a water tight box. Ss All property holders in the city Jl furnish metal covered gar- cles in the rear of the premises where said contractor may have easy access to said receptacles between the first day of May and the first day of No- vember, cach year. Sec. 4. Any property holder vio- lating any of the provisions of Section 3 of this ordinance shall be punished, upon conviction, by a fine of not less than five dollars nor more than twen- ty-five dollars and costs, or by impris- onment of not less than five days nor more than thirty days, or both. And it shall be unlawful for the police magistrate to remit any fine levied hereunder. Sec. 5. All ordinances and parts of ordinances in conflict with this ordi- nance are hereby repealed. Sec. 6.
