As unassailable authority on the part of the leg- islature, ‘the judge = pointed tothe Nineteenth Amendment to the federal Constitution as estab- - lishing the new status for women. Tt can be quickly conceded that when the writers of the American Constitution drafted that instru- ment they were not so much concerned over the personnel of the jury as they were over the broader principle that in this'land every man should be given a free and impartial trial. It is most natural that in those days.they should not have considered the possibility of mixed juries. ‘ Y3 :,/They ‘decreed that “in all eriminal prosecutions the accused shall’ enjoy the right to a speedy and public trial ‘by an impartial jury of the state and district wherein the crime shall ‘Have been - com- mitted,” but they did not stipulate anything about men or women in 50 many words.
