OFFICIAL' PROCEEDINGS ' OF THE BOARD OF COUNTY COMMISSION- ERS OF BELTRAMI COUNTY, MIN=|N NESOTA, MAY 4TH, 1920. The Board of County Commissloners of Beltrami County, met on Tuesday, May 4th, 1920, at 10 o'clock in the fore- gursuant to adjournment. Members present: idward Paulson, Hans B, Imsdahl, James F. Hayes, Wm. Lennon, and 8. W. Ellis, The minutes of the previous meeti were read, with a correction on page 70, the seventh {mragmph, relating to_the establishment of a county road in Wa- banica and Wheeler townships, which should read: (CommenclnF at the NE corner of the SEY of Section 24, Town- ship of Wheeler, and running west 3-4 of a mile and thence south mile, thence west of a mile along the sec- tion line, thence south 4 miles, thence east 1 mile and there ending); and a correction on page 68, the second paragraph, the amount shown is $493.30, and should read ($2968.79 be transfer- red to the Construction Fund of State Rural Highway No. 62.). Upon motion of Ellis, seconded l:iy Paulson, the min- utes were approved as corrected. ‘Commissioner Ellis_offered the fol- lowing resolution and moved its adop- tion: Whereas, the Farmers State Bank of Grygla, during the I/enr 1918, was duly designated as one of the depositories of the funds of this County, and on'the 9th day of March, 1918, there was de- posited in said bank by this County the sum of $8,000, and said bank issued to this county its certificate of deposit, dated on said day, for said sum of $8,000 payable one year after date, with inter- est at the rate of four per cent per an- num, and ‘Whereas, to secure the repayment to this County of said deposit said bank executed and delivered to this county two bonds, one for the sum of Five Thousand Dollars, with Lion Bonding & Surety Com&;anf as surety, and the other for $3,000, with Fidelity & Depos- it Company, of Maryland, as surety, and ‘Whereas, said bank, on the 22nd day of June, 1918, became insolvent, and the Superintendent of Banks of this State took charge of its assets and af- fairs, and the same is now under the control of said Superintendent of Banks in_ such liquidation proceedings, and this county has filed Its claim on sald certificate of deposit with sald Superin- tendent of Banks, and the same has been allowed by said Superintendent of Banks at the sum of $7,313.20, being the amount of said certificate of deposit, and interest to the date of the closing of said bank, less a credit of $778.36, being the amount of a claim owing by this county to one Sak Erickson, and assigned by said Erickson to said bank, and unpaid by this county to said bank at the time of closing of said bank, and ‘Whereas the Lion Bonding & Surety ‘Company has paid to this county fits proportionate share under its bond on said deposit, being 5-8ths of the amount of the claim of this county against said bank, with interest, amounting to the sum of Five Thousand twenty dollars and eighty cents ($5,020.80), And whereas the Fidelity & Deposit Company, of Maryland, has paid to this county its pro ortionate share under its bond on sald deposit, being 3-8th of the amount of the claim of this coun- ty against said- bank, with interest amounting to the sum of Three Thous- and Twelve dollars and fifty-one cents (33 012.512; : Now, therefore,” be is resolved, that the County Treasurer of this County forthwith file with said Superintendent of Banks sald oriFinal certificate of deposit, and that gaid Superintendent of Banks be and he is hereby authorized and directed to pay to the said Lion Bonding & Surety Companf five-eighths (5-8th) of any .and all dividends that ma?' ‘become due and payable on the claim of this county against sald bank, sa filed and allowed, as they become due and payable, and that sald Superintend- ent of Banks be and he is hereby au- thorized and directed to pay to the said Fidelity & De%oalt Comgany of Mary- land, three-eighths (3-8ths) of any and all dividends that may become due and payable on the claim of this count against said bank, so filed and allowed, as they become due and payable, and that a certified copy of this resolution be transmitted, with said original certi- ficate of deposit, to said Superintendent of Banks forthwith. Said resolution was seconded by Com- missioner Imsdahl and being put to vote was unanimously adopted, and by the chairman then presiding so declared. 76, The application for road money, from 3 the Towns of Turtle River, Eugene, and Sugar Bush were laid on the table until funds became available in the County Road and Bridge Fund, when the mat- ter of Appropriation would be taken up by this Board and disposed of. A petition for re-survey of Sections 25, Township 149, Range 31, was pre- sented and same being in due form, was set for hearing on June 1st, 1920, at 11 o'clock in the forenoon, In the com- missioners’ room in the Court House at Bemidji, Minn, Where; vetition has been present- ed to this board, signed by O. E. Run- dell, et asking that the N&g ot Section , and all of Section 27 in the District No. 56, and all of Sections 35 and 36 in the District No. 46, be in- cluded in District No. 108, all in the Township of Durand. Therefore, be it resolved that hearing upon_said petition will be had by this board at its regular meeting on Tues- day, the 1st day of June, 1920, at 2:00 o'clock in the afternoon, in the com- missioners’ room in the Court House, in Bemidji, and that said Board will hear all that may be said in favor of and against the granting of said petition and that notices be posted of said hear- ing as provided by law. Commissioner Ellis moved the adop- tion of the resolution, the same was seconded by Commissioner Hayes, and be"‘F put io vote duly carried. ‘Whereas, a petition was presented to this board by Martin Sorenson, et al., praying for the establishment of a county road beginning at the SE corner of Section 3, Township 146, Range 35, and running thence north between Se tions 2 and 3, Township 146. Range 356, Sections 34 and 35, 26 and 27, of 'Fown- ship 147, Range 35, to the east quarter corner of Section 27, Township 147, Range 35, and there ending. Therefore, be it resolved that hea; ing will be held upon the above me: tioned petition in_the commissioner room in the Court House in Bemidji, on Monday, July 12, at 2 o’clock in the afternoon, at which time and place said board will hear all that may be said in favor of or against the granting of said petition, and that Commission- ers Paulson and Hayes, members of this Board, be and they are hereby appoint- ed a committee to examine the route of said road and that this committee meet upon the route of this road at the SE corner of the NE of Section 27, Town- ship of Lammers, on Tuesday, the 22nd day of June, 1920, at 4 o’clock in the af- ternoon, for the purpose of examination of said road and make report before said meeting of said board hereinto- fore specified and that notices be posted as_provided by law. ‘Whereas, the petition of E. Moved, seconded and carried that the following applications be approved and referred to the Minnesota Tax Commis- slon: Felix Scott, Matilda Wistrom, George Hoh, Patrick Cassen. The application of H. A. Hanson, which last laid on the table at the last meeting of the board, was considered by the board, and in the judgment of the commissioners, the same should not be granted, as the assessment shown by the assessor of the town board was not out of reason with the cost, as shown by the furnishing house. Therefore, it was moved by Ellis and seconded by Imsdahl that sald ngplioa- tion be rejected. A Motion carried. The petitions for resurvey in Sec- tion 32, Township 150, Range 32; Sec- tions 3 and 4, Township 148, Range 31; Section 30, Township 149, Range 30, and Section 7, Township 149, Range 30, came up for hearing. There being no objections made, it was moved by Ellis and seconded by ‘Ha*ga. that these be granted and that R. K. Bliler be appointed to make the surveys of sections as follows: 32-150-32, May 17, H 3"and 4-148-31, May 24, 1920; 31-149-30, May 381, 1920. 7-149-30, June 7, 1920. The petition of Loule Larson, a free- holder in School District No. 20, came up for hearing. No one appearing for or against such petition, the members of this board feel that District No. 20 should not be reduced in valuation, which would cripple District No. 20. Therefore, it was decided to rejéct such petition, which was moved by Ellis and seconded by Paulson, and duly car- ried. The petition of Swan A, Friberg, et al came up for hearing, asking that this board set off SWi of SW of Section 23,, Township 149, Range 31, over to District No. 41. . As this tract of lana is entirely separated from District N 60, it was deemed advisable by thi board and according to law. that' this tract be transferred to District No. 41 Motion 'br Ellis to this effect, secon ed by Paulson, was duly carrled. The petition of Mrs. Myrtle Theriault, which was acted upon by the county board at a previous meeting was. re- scinded, owing to_the fact roperty did not adjoin the unorganized erritory, but was separate and a part of District No. 28. Therefore, it was moved by Commis- sioner Ellis, seconded by Imsdahl, that this board reconsider and revoke the order setting off Mrs. Myrtle Theriault, whose lands are described as follows: Slz}’,@)4 of NEa of Section 4, SW& of NWi; of Section 3, and N5 of SE¥% of Section 3. Motipn carried. The petition of Willlam Mielke, et al., for the establishment of a school district in north -half of Big Grass township, which was laid on ‘the table, was taken up and after discussion by the board, it was deemed advisable to reject the petition, due to the fact that there was not_sufficient valuation to finance a school district. Motion was made by Commissioner Hayes and_seconded by Ellis. Same duly carried. Matters concernln% the petitions_of School Districts No. 95, No. 20, and No. 121, which have been laid on the table, inciuding the petition of Peter Buch and John Knutson, will be brought up for hearing at the next regular meet- ing of the county board, which will be held on Tuesday, the 1st day of June, 1920, at 3 o'clock in the afternoon. The board at that time will hear all the ar- guments in favor of or against the granting of these petitions. The matter was moved by Commis- sioner Ellis, seconded by Paulson, and duly carried. Whereas, a petition of Frank Porter, et al., freeholders in School District No. 39, was presented to this county board, asking for the recovery of Sections 1 and 20, 29 and 30, 31 and 32, from Dis- trict No. 40, Therefore, be it resolved that hear- ing be_had upon said petitino at the Court House in Bemidji on Tuesday, the 1st day of June, 1920, at 2 o’clock in the afternoon, at which time and place said board will hear all that may be sald in favor of or against the frantlng of said petition, and that notices be posted as Rrovldcd by law. Due to the lack of funds the county hoard will,_commencing June 1st, fuse to accel)t any petitions for resu vey of sections of land in Beltram county. =~ ° Commissioner Ellis, making the reso- lution was seconded by Hayes and mo- tion being put to vote was duly carried.
