/ $25,000 DAMAGE SUIT FILED; ECHO OF SCHOBL WRANGLE Spooner, Minn., Sept. 24.—Former Superintendent of Baudette Schools N: B. Schwartz has filed suit against C. R. Middleton for $25,000 damages. The suit is a sequel to the recent school controversy in that village. Mr. Middleton, while president of the school board, refused to sign a contract with Mr. Schwartz and was instrumental in inducing his son, E. C. Middleton, to. bring an action re- straining the school board from pay- ing any salary to Schwartz. The latter then brought mandamus pro- ceedings against Mr. Middleton and the matter was finally decided in the supreme court, where Mr. Schwartz was allowed his salary and sustained on most points in the con- . troversy. Damages are now claimed for the wrongful interference by Mr. Mid- dleton with the rights of N. E. Schwartz, specifically in refusing to sign Mr. Schwartz’ contract; his wrongful act in having his son begin the injunction proceeding; the wrongful act of Mr. Middleton in slandering Mr. Schwartz through the public press, and also that Mr. Middleton at various times and pla- ces had made threats to ‘‘get” Mr. Schwartz. The action will probably come up for trial at the next term of court to be held at this end of the county. The papers were served by Deputy Sheriff Dundas and the defendant has twenty days in which to make an- swer to the charges. Although Monroe had the same chance of es- eape as his cellmate, he neither aided Dwyer nor made any attempt to leave his cell, it is said. “No, I thought I would rather go down and serve it out than «have them after me for the rest of my days,” was Monroe’'s reply when ask- ed if the hole was too small for him to get through. Has Bad Record. Whether or not Dwyer is ‘“hard hoiled” he at least has a record. This is the fourth time he has been con- fined in the Beltrami county jail. A short time ago he was put in the Duluth jail and escaped over. night, and has had many other “experien- ces.” -After escaping from the Du- luth jail he returned to the Cass Lake Mission and three was arrested for bootlegging by a federal officer and brought to Bemidji and confined in the county jail. Claims Had Saw. Dwyer claims that he had the saw concealed in the leg of his trousers when he was put in jail and could have escaped before if he wanted| to. The officers’ theory is that as Dwyer was in the cell with four other prisoners who were charged with robbery, his plan was to wait until they all got their sentences and then free the whole bunch, but as all the rest were freed except Mon- roe and as he wouldn't attempt es- cape, Dwyer had to take his chance alone. Dwyer will probably be tak- en to Leavenworth in a short time.
