The trouble with some communities, in the matter of their progress, 18 that there is too blamed much “figgerin.’” The citizens well know what the matter with the community is, or rather what its needs are in the line of improvements or movements for s step forward, and they sometimes reach the point of getting together and discussing whatever they may have in mind. They will appoint a chairman and a secretary of the meeting and then the chair announces what it is all about as he “has been informed” and the meeting is then open for discussion of the proposition. . There will be remarks by some of the “leading citizens” of the com- munity and they gravely and learnedly elucidate on what ails the city, and after diagnosing the case thoroughly they will reach the remarkable conclusion that “something ought to be done.” And s0 it goes throughout the evening, until the meeting place is well filled with various brands of smoke and until everyone commences to yawn and look at their watches and twist in their chairs and wish to goodness some one would ‘“ocut it out.” The finale is the appointing of a committee to investigate and report sometime or another and then every- body grabs his hat and hikes for home, because he had told the missus he wouldn’t be out late. W., we happened to notice in their headquarters in Bemidji a sign prominently displayed on the wall . AN ORDINANCE authorizing the PUBLIC IMPROVEMENT COMPANY, of Minneapolis, and its assigns, to ac- quire and construct, and to maintain and operate gas works in the City of Bemidji, Beltrami County, Minnesota. Sec. 1: Whenever the PUBLIC IM- PROVEMENT COMPANY is named or understood in this ordinance, the same shall be taken to mean and include said Public Improvement Company of Min- neapolis, Minnesota, its successors ang assigns. The term gas plant, whenever herein. shall taken mean and_include the gas plant of said Public Improve- ment Company of Minneapolis, Minne- sota, its successors and assigns, to- gether with all the property and appur- tenances connected therewith or in any way pertaining thereto. The Common Council of the City of Bemidji_do ordain: Sec. 2: That Public Improvement Company and its assigns be and it is hereby authorized to acquire or to con- struct and maintain and operate for a period of twenty-five (25) years from and after the passage of this ordinance, works for the purpose of manufactur- ing and distributing gas for light, heat and power purposes, and for that purpose to lay pipes and mains in and under each and every one of the streets, avenues, alleys, parks and public places of the City of Bemidji, and over, un- der and upon all of the bridges and cul- verts connecting with any street; for the purpose of laying and relaying and repairing pipes, to enter upon and to excavate said streets, avenues, alleys, public parks and public places, but in so doing shall restore the surface there- of to as good a condition as before said excavation was made, as nearly as prac- ticable and as speedily as can reason- ably be done, and all such work of con- struction and improvements shall al- ways be done under reasonable direction, supervision and control of the City of Bemidji. Sec. 3: The said Public Improvement Company and their assigns shall lay the gas mains provided for herein, on the side of the streets, avenues, alleys and public highways, opposite that used or occupied by the water mains in said streets, avenues, alleys and public high- ways, and shall at all times, in laying said gas mains and gas service pipes, use care and diligence in the removal of earth, pavement or sidewalk, and shall restore said earth, pavement or sidewalk to the original condition or to a condition sausfactory to the City Council. Sec. 4: Said Public Improvement Company_ shall not in any manner un- necessarily obstruct, impede or inter- fere with the free, safe and convenient use of said streets, avenues, alleys, pub- lic park and public places for public pas- sage or other legitimate public pur- W. It shall be Hable for such damages as may be suffered by any person or corpora- tion by reason of any negligence in its use of said streets, avemues, alleys, pub- lic parks and public places, under this ordinance, and shall hold said City harmless on account of any damage oc- casioned by such negligence. Sec. 5: Said Public Improvement Company, its successors and assigns shall_manufacture and supply gas or light equal in quality to what is known as sixteen (16) candle power. The gas manufactured and sold by said Public Improvement Company may be either the kind known as Water Gas or the kind known as Coal Gas; pro- vided that the construction of the gas plant shall begin within a period of two months from the passage of this or- dinance and that the work of construc- tion shall continue without unnecessary delay until completed. sec. 6: That if the City of Bemidji or its contractors shall find when extend- ing, repairing or installing any water, sewer or other pipes belonging to said City, that such water, sewer or any other pipes will be intersected or interfered with by Public Improvement Company’s gas pipes or mains, and such water, sewer or other pipes cannot be reason- ably laid in any other part of said street, then and in such case, said Pub- lic Improvement Company shall on be- ing notified by the Common Council of said City, at its own cost and expense, immediately remove or relay the same so as to avoid such interference. Sec. 7: That said Public Improve- ment Company is hereby authorized to vend gas for light, heat and power pur- poses, to all inhabitants of the City of Bemidji, and_hereby authorized to col- lect and receive for gas during the first five (5) years after the passage of this ordinance, and until a revision of rates as hereinafter provided as follows: Gas used for illuminating and heat- ing purposes, the sum of $1.60 per thousand cubic feet, and consumers shall be entitled to a discount of ten cents (.10¢) per thousand cubic feet from the foregoing price, provided payment therefor is made on or before the tenth day of each month, at the office of the Company, for gas consumed during the previous month. The price to be charged for gas used by said City in Street Lamps or for lighting and heating purposes in Muni- cipal buildings or offices, shall be twenty per cent (209 ) lower than the net cash price char; private consumers. Sec. 8: That the rates to be charged for gas manufactured by said Public Improvement Company, its successors or assigns, within the City of Bemidji, may be fixed and adjusted at_the end of each period of five years, during the con- tinuation of this ordinance, as follows: First: By and between the Common Council of the City of Bemidji and the said Public Improvement Company, its successors or assigns, if they can agree. If they cannot agree upon rates, then said rates shall be fixed and adjusted by three disinterested per- sons, not_more than one of whom shall be a resident of said City; one of whom shall be appointed by said City, and one by the Public Improvement Com- pany, and these two shall select a third person. In case the two persons thus selected cannot agree upon the third such third person' shall be ap- pointed by the Judge of the District Court in which said City of Bemidji may then be situated. Their decision after hearing the parties and evidence as to the then existing conditions, prices of material used in manufactur- ing gas, freight rates and _ prices charged for similar gas in neighboring cities of the state of similar size, the value of all the property used by said Public Improvement Company under this franchise, the annual depreciation thereof, and all other evidence relevant to the matter shall be final for the next ensuing iod_of five years, but the rates so fixed shall not exceed the rates fixed by this ordinance. Sec. 9: The manufacture and sale by said Public Improvement Company, its successors and assigns, of gas of a lower standard than herein provided for, or the failure of said Public Improve- ment Company to manufacture and vend gas as herein provided, shall render its or their rights and franchises hereun- der voidable; provided, however, that a temporary failure which is remedied as soon as reasonably practicable shall not bemground for declaring said franchise void. Sec. 10: At the expiration of ten years from the date of the passage of this ordinance and at the expiration of any period of two years thereafter, the said City of Bemidji shall have the right to purchase the gas plant of said Public Improvement Company, its suc- cessors or assigns, at such price and on such terms as may be mutually agreed upon; but in case a mutual agreement cannot be made, the said City may give notice of not less than six months in advance of its intentions tc purchase said gas plant. Within thirty days thereafter, said Public Improvement €ompany shall appoint a disinterested non-resident and said city shall s:?. point a disinterested resident of a city, these two to select a third diasin- terested non-resident of said city. In case these two persons thus selected can- not agree upon a third person such third person shall be appo‘nted by the judge of the District Court of the iu- dicial district in which said City of Be- midji may then be situated. These three persons so appointed shall con- stitute a commission to examine and take testimony of experts and other- wise determine the value of said plant and report in_ writing what in their opinion would be a reasonabie price for said City to pay for said plant. The city shall thereupon have the rigat, within ten days thereafter, to exercise the option to take the gas nlant and all property and appurtenances coanected therewith or in any manner appertaining thereto at the price so fixed, which pur- chase money shall be payable to said Public Improvement Company within six months from the time that City shall so elect to purchase. And in case the city shall after such award, fail or refuse to purchase it shall pay the necessary expenses incurred by said Public improvement Company in and about the said award; but in case the city elect to purchase, each party shall pay its own expenses so incurred and the expense of the arbitrators 'shall be paid equally by said City and #aid Pub- lic Improvement Comj Y. . 11: Said Public Improvement Company shall supply gas to said of Bemidji for streets lamps and for lighting and heating purposes in mu- nicipal buildings and offices _along the line of the mains of said Public Im- provement Company, or any extension thereof, and to all stores, dwellin offices and other buildings along e line of the mains of said Public Im- provement Company, or any extension thereof when the necessary arrange- ments have been made to receive such and when all reasonable rules and regulations of said Public Improvement Company have been complied with. Sec. 12: d Public Improvement Company, its successors and _assigns shall be permitted to make and collect a minimum charge of fifty (50) cents per month from each and every consum- er whose meter does not show a con- sumption of gas in excess of that amount. Sec. 13: Said Public Improvement Company, its successors and assigns shall in all cases furnish service pipes for consumers’ use from the gas m.§:. to the property line without cost or ex- pense to the consumer.
