Atlanta, Ga., April 17.—Possible basis for appeal of the case of Leo M. Frank, under death sentence for the murdér of Mary Phagan,*to the supreme court of the United States, ‘was laid in a motion for annulment of his sentence, filed. in superior court here. / The motion charges that the pre- siding judge at Frank’s.trial advised counsel for the defense that in the event their client was found guilty it would be unsafe for him to be in court when the verdict was an- nounced and that such action was in violation of the federal Constitution. The motion was filed by a local law firm hitherto not connected with the case. , Attorneys who have been in charge of Frank’s defense said the action was taken without their knowl- adge. i WITNESSES APPEAR ~EAGER TO TESTIFY Change Minds When Indictments Are Threatened. ‘Washington, April 17.—Facing prob: able indictment and criminal prosecu- tion for refusal to respond to “lawfui questions” of the interstate commerce commission in the New Haven in- quiry respecting the operations of the Billard company some of the recal- citrant witnesses have indicated their willingness to testify. Josepn W. Folk, chief counsel of the commission, received a letter from Hénry Stoddard pf New Haven, Conn., Tepresenting two of the witnesses, in- sisting that it was “unfair” to his clients for the commission to invoxe the criminal statutes against his clients. He feels that “in all justice” the points in issue ought to be threshed out in a civil proceeding. His clients, it was pointed out, did not wish to be placed under the stigma of an indict- ment and rather than suffer such hu- miliation would give their testimony wunder protest. Leavenworth, Kan., April 17 —~Convicts employed in the twine plant at the Kansas state penitentiary have agreed to a proposition made hy the state board of corrections to work overtime, in order to meet the demands by Kansas wheat growers for binding twine.
