ATTORNEY’S PLEA FAILS Counsel for Senator Asked That Pro- ceedings Be Postponed Until After the November Election, but This the Committee Refused to Do—Tak- ing of Evidence Expected to Begin Early Next Week. Chicago, Sept. 24—The senatorial subcommittee on privileges and- elec- tlons, which convenad here to inves- tigate the alleged fraud and corrup- tion in the election of Senator Will- jam Lorimer, decided to proceed at this time with the taking of testimony and not to postpone action until after the November elections, as urged by the-senator’s attorney, Elbridge Han- ecy, at the first open session of the committee. At the opening of the day’s session Chairman Burrows also announced that the committee would permit At- torney Alfred S. Austrian, represent- ing the Chicago Tribune, and former Judge Elbridge Hanecy, representing Senator Lorimer, to appear in the hearing. Attorney Hanecy presented his for- mal motior for a continuance of the hearing until after the November elections. The reasons advanced were in substance similar to the argument made by him previously, when he de- clared that Senator Lorimer would be handicapped through a disinclination of legislators now under indictment to testify before the committee. Thé Tribune’s list of witnesses was submitted and the committee began consideration of methods of procedure. Decides Against Postponement. The committee’s decision overrul- ing Senator Lorimer’s plea for delay was announced by Senator Paynter of Kentucky, who said: “The committee has given due con- sideration to the presentation made for a continuance of this hearing until after the November elections and has not found the reasons contained there- In of sufficient weight to warrant the delay. The petition is denied.” No reference was made to the defi- nite time when the hearing would be- gin, but after submission of the names of the witnesses by the mewspapers a short conference resulted -in the an- nouncement that the session would adjourn as a public meeting until Monday morning to permit Senators Bulkeley of Connecticut and Frazier of Tennessee, other members of the investigating - subcommittee, to be present. The committee then went into ex- ecutive session with Attorneys Aus- trian and Hanecy to determine upon the rules of practice that would ob- tain at the hearing.
