TAGGART GETS DECISION. Receiver Will Not Be Appointed for French Lick Hotel. Paoli, Ind., July 17.—Judge Thomas B. Buskirk, in the Orange county court, sustained the third section of the demurrer of the French Lick Springs and West Baden Hotel com- panies against the petition in quo war- ranto of the state for a temporary re- ceiver. and temporary injunction sgainst gambling at the resorts. In this third section the hotel com- panies set up that the allegations of the state in its complaint do not state facts sufficient to constitute a cause of action against them. He overruled the two sections of the demurrer in which they assert that the prosecut- ing attorney was not the proper re- lator for the state in such proceedings and the state has not the legal capac- ity to sue. Attorney General Miller served no- tice of appeal to the supreme court. Bhould the supreme court reverse his decision the state’s information will be gent back to Judge Buskirk’s eourt for trial. Should the supreme court afirm the decision the case will be thrown out of court. Rising From Its Ashes. 8an Francisco, July 17.—San Fran- Msco is rising from its ashes with great rapidity. TiM IN THE PUBLIC PARK AT PETERHOF, St. Petersburg, July 17.—Additional details of the assassination of General Kozlov of the headquarters staff in the park at Peterhof on Saturday prove beyond question that the mur- derer believed he was killing General Trepofft. The tragedy cccurred at 9:20 in the evening in the presence of sev- eral thousand people who were listen- ing to the music in the English park, below the grand chateau adjoining the park of Alexander palace, where the imperial family and General Trepoff reside. A young man, dressed in the clothes of a workman, seeing General Kozlov, who resembles General Tre- pofl, gazed long and earnestly at the general’s face and then took a photo- graph from his pocket to compare it with Kozlev’s features, as if to make sure of his identity. The man then drew a pistol and fired four shots point blank at Kozlov, who fell mor- tally wounded and died on the spot. The assassin was arrested. He re- fused to give his name, although he openly avowed that he was a member of the social revolutionary organiza- tion and the police have not yet been able to find out his name, General Kozlov was not involved in politics. He married a granddaughter of the famous field marshal, Count Al exander Suvaroff. MUTINY AT ST. PETERSBURG. Whole Regiment Backs Two Men Who Refuse to Obey Orders. St. Petersburg, July 17.—There was an incipient mutiny in the fortress of St. Peter and St. Paul during the day. Two soldiers refused to obey the or- ders of their commander and when threatened with arrest the whole regi- ment to which the two men belonged came to their support. Some people have been pro- ducing wealth which I have consumed. T can put that better. Some working people have been depriving them- selves of the wealth which they have produced in order that I might live in idleness and luxury.” This would continue, he said, until the working people woke up to their power. Without firing a shot or build- ing a barricade, he said, the working people of the country, by the use of the ballot, could put a stop te it. “It will not stop until then,” he add- ed. “The capitalistic class will never say the word.
