General ordinance of the City of Bemidji establishing water rates and penalties for the government of patrons of the system, licens- ing plumbers and regulating the use of city T, T Aoy clty council of the Olty of Bemidjl does ain: Section 1. The rules and regulations and water rates hereinafter named together with such other rules and regulations asmay here- after be enacted, shall be a part of the con- tract with every person, company Or cor- poration. who now are, or may hereafter be supplied with water through the water system of the city, and every such person, company or corporation, by the use of such water shall be considered to have assented to all the rules and regulations hereinafter named and to be bound thereby, and when- ever any of these rules and regulations is violated the water shall be immediately cut off from the building or place of such viola- tion, and shall not again be turned on except by order of the superintendent, and on pay- meny of the ct thereof, which in no case be I than #2, and on such other the rules and regulations may further impose, and a satisfactory assurance that no farther cause for complaint shall arise. and in case of such violation the super- intendent shall have the right to declare the payment made for water rent. by the person so violating any of these rules and regula- tions forfeited. APPLICATIONS AND PERMITS. Section 2. (A) All applications for the in- troduction of water into any premises, or for the exteasion of any water pipe. shall be made by the owner of such premises, or by his duly authorized agent, or attorney, on printed blanks for the purpose. to the super- intendent, which said app'ication must state fully and truly under oath all the purposes for which water is required, and should ad- ditional use be at any time desired, the per- son desiring the same must make a new ap- plication before the same will be allowed. (B) All applicants must subscribe to and agree to be bound by, the rules and regula- tions governing the use of city water at the time of such application, or which may there- after be made by the city council, and there- upon a permit shall be issuea by the superin- tendent authorizing any duly licensed plumber to make the desired connection with | the mains. provided, however, that no main or water pipe shall be tapped except by the superintendent, or under his persunal super- vision, and for which the applicant for such connection shall pay to the superintendent the sum of $3.00, and he shall once in each’ month turn over to the city clerk. all monies so received, and the superintendent shall keep a record of the location of all such taps, in a book provided for that purpose. (C) A special permit must be issued for each special service connection, and each building, residence, business place, etc., also for each branch connection when more than one conection is made by one service pipe. (D) A special permit must be issued for making any extensions to, or alterations to! the plumbing of any house, store or other huilding, beyond that for which permission may have already been granied. (E) Where the service pipes are intended to supply two or more distinct prem ants and where only one service cock is used, the application must be made by the party controlling the sam at his office in the city hall in said city on the 1st day of January and the 1st day of July, each year, and if not paid within ten days thereafter the clerk shall make a list of all ‘| delinquent water tax payers and deliver the same to the superintendent, who shall forth- WATER LEASES AND REN Section 3. (A) All water rents are due and payable semi annually in advance to the city elerk. who is for the purposes of this ordi- nance designated “Clerk of the Water Board., with proceed as directed in section one (1) of this ordinance. Y (B) Except where meters are used. no water lease will'be issued for a less period than six months. and date from the first day or January Or July. =5 (C) No rebate will ‘be allowed for partial use of water from wells, cisterns, etc., an parties desiring to make only partial use of city water may procure and set a meter to be approved by the superintendent, at his own expense and thereafer pay for the water used at meter rates. The right is reserved to attach meters to any service Dipe when deemed expedient by the superintendent, and thereafter charge will be made for the amount of water actually used, such payment to be made to the clerk as aforesaid, every thirty days, subject to the same penalty in case of failure to make such payment, as in cases where an annual orSemi annual rate is charged. (D) Contracts or leases may be transferred by parties desiring to vacate any premises, but the city will not refund any portion of such unexpired water leases under any circumstances. ) No claim shall be made against the city by reason of the breaking of any main, pipe, service pipe or cock, or for any other interruption to the service, or by reason of the breakage of machinery, or stoppage for necessary repairs, and no deduction will be made for any time that private water pipes may be frozen. (I") Water will not be turned on for any Derson, Or any premises, except where meters may be used, until the applicant shall have paid for rent of same six months in advance, and shall exhibit his receipt therefor, and plumbers are strietly forbidden from turning the water into any service pipe except upon the order of the superintendent, they may however turn on the water for the purpose of testing such pipes and for no other purpo: (G) No occupant or owner of any premis to which water is supplied shall supply water to other p ns, or permit the same to be used or taken, any person or consumer violating this rule will be charged donble the usual rate, and upon his failure to pay same on demand the water will be immediately turned off. (H) Parties desiring water for cisterns, tanks, or other intermittent supply will be charged regular rates as per edule. or they may furnish at their own expense a water meter, and pay the regular meter rates. (I Parties desiring to build or repair building, for which water from the system is to be used, shall make application therefor, giving the certified statement of the architect, builder or contractor, of the num- ber of bricks, perches of masonery, yards of plastering to be laid, or barrels of lime or cement to be used,or other purposes for which water will be used, and pay the schedule rate therefor, and the superintendent shall there- upon grant a permit to use the water for the purposes named in the application. Any abuse of this privilege, or neglect to guard against the use of water for purposes other than those named in the application and permit, will subject the owner to having his supply cut off, and not restored until sat- istactory evidence is shown that such abuse will not occur again, and the payment of $1.00 costs, which shall be deposited to the credit of the water works fund. Section 4. Hydrants, taps, hose, water closets. baths, etc., must not be left running when not in actual use, and water will not be turned on in.any premises having wasteful or improper fixtures. (D) No person, firm or corporation will be allowed to put in hydrants, sprinklers or pri~ vate fire plugs without stop cocks attached. (E) All service pipes, corporation cocks and stop cocks from street gnd avenue mains will be put in by the superintendent, from the mains to the outer edge of the sidewalk orcurb and the cost thereof charged to the applicant, and the length of ‘pipe used shall be considered as one-half ‘the width of the street or avenue regardless of the location of the main, and the cost of service pipe, stop cock and corporation cock shall be twelve (812.00) dollars when only. one corporation cock is used, if more than one isused an addi- tional charge of $1.00 each will be charged for each after the first. HAND HOSE AND FOUNTAINS. Section 6. (A) No hoseof any kind shall be used unless a permit has been properly ap- plied for and allowed by the superintendent. Arranging hos temporary or fixed supports, or devi any kind arranged to sprinkle automas 3 will be regarded as fountains and subject to charge at the same rates fountair (C) In sprinklingstreets each water taker must confine himself to the exact frontage paid for, and to one half the width of the street or avenue. - (D) The use of hose for sprinkling streets, lawns, gardens and washing sidewalks, steps, windows. etc., will be allowed only between the hours of six o'clock and nine o'clock a. m. and between the hours of five o’clock and eight o'clock p. m.eachday. but when- ever there is an alarm. of fire the use of hand hose and fountains must be immediately dis- continued, and the superintendent may order the discontinuance of the use of such at any time, when public welfare may -require such discontinuance. ' (E) Yard fountains shall not be used more than six hours per day, and at and between the hours named in paragraph (D) of this of- dinance, and only from April 15th to Novem- ber15th of any year. PLUMBERS. Section 7. Any plumber or pipe fitter wishing to do any work or perform any ser- vice in connection with the city water works, must first file-in the office of the City Clerk his petition in writing, giving the name of the firm and each member therof, place of busi- ness and asking to beconie a licensed plumber or pipe fitter in connection with said city water works. stating his willingness and con- sent to be goverhed in all respects by the rules and regulations of the water works de- partment, made. (B) Before receiving a license the appli- cant shall execute and deposit in the office of the City Clerk a bond with two or more sure- ties to be approved by the city council in the sum of five hundred (3500) dollars that he will indemnify and save harmless the said city of Bemidji from all damages caused by any negligence in properly protecting his work. or by any unsubstantial or inadequate work done by virtue of his license as such plumber or pipe fitter, and that he will replace and restore any pavement or sidewalk that it may be necessary to remove, and to properly refill all excavations, and that he will pay ail fines that may be properly imposed upon him for violating any provision of this ordinance, or of any amendment thereto, The fee for such license shall be ten ($10.00) dollars per annum, payable to the City Treasurer. (C) Any plumber or pipe fitter who shall be guilty of a violation of any of the established rules and regulations of the department, and shall do, or cause to be done, poor or defec- tive work, shall forfeit his license and be subject to a fine of not less than teu dollars nor more than one hundred dollars aud costs of prosecution. (D) Within twenty-four hours after com- pleting any attachment or connection such plumber or pipe fitter shall make a true re- port to the superintendent of the number of rooms, water closets, bath tubs and ovher fix- tures used on the premises and the con- templated use of water therein and the loca- tion and length of the service pipe, and no water will be turned into or onto any premises until such report is made. No addition to or any alteration what- ever of any tap. pipe or water cock or other fixture in any premises shall be made by any plumber except where the owncr or tenant shall first have obtained a permit therefor, and no plumber shall turn on the water in or on any premises except for the purpose of testing pipes until he shall have reported as directed in section (D) of this section. RUI'ES FOR PLUMBING. Section 8. (A) No service cornection or other attachment to any of ‘the water mains shall be made except by lead pipe three- inch in diameter, and be made by what known as a plumber’s “wipe_joint’ and cock screwed into the main, and inno case must lead pipe be used between the main or stop cock weighing less than as follows: Lead pipe X inch medium one psund per or such as may thereafter be foot. 5 Lead pipe % inch medium, one pound per 00%. Lead pipe one inch., extra strong, four pounds twelve ounces per foot. 7 Lead pipe % inch extra strong pounds, nine ounces per foot. Al iron pipe must be made of a quality known as extra strong, lap welded and must be coated inside and out with Dr. Smiih’s preparation, applied when both are heated 10 a temperature of 300 degrees Fahrenheit. (B) Each service pipe shall have a stop cock or service cock placed just inside the curb line or outer edge of sidewalk and be protected by an iron box with cover.and both the stop cock and its protecting cover must be of the pattern adopted by the city, and which may be seen at the superintendent’s office. (0). Where any service pipe is intended to supply two or more consumers there musg a separate service cock for each. All service pipes must be laid below the frost line, at least elgut feet deép. All taps‘n mains shall be at least eighteen inches apart, and on opposite sides of the pipe, and no tap shall be made closer than six inches to the joint, the brass ferule or nipple tapped into the main shall be one-eighth of an inch smaller than the service pipe theretrom. (E) There must be a stop or waste cock at- tached to every supply pipe at the poing where it enters the building, inside the same So as to enable the water to be shutoff in frosty weather and the pipe emptied. (F) In putting down or repairing service pipes the streets. avenue or alleys must be opened at a time and in a manner which will cause the least inconvenience to the public, subject to regulation of the city ordinances and every precaution must be taken to in- sure the public safety. All excavations re- maining open over night, must be securely enclosed and a red light kept burning thereon or thereat from early twilight until day light next morning. © MANAGEMENT OF WATER WORKS. Section 9. The city council shall appoint one man who shall be known as superintend- ent of water works, and who shall give a bond in the sum of five hundred dollars, to be approved by the city council for the faithful perforimance of his duties, and the city clerk shall be constituted and is hereby constituted clerk of the water board. (B) It shall be the duty of the superin- tendent to see that the rules and regulations ot the city council relative to the water' system of said city are executed and complied with, and .perform such other duties as the city council may prescribe, and receive such salary as the council may direct. (C) The clerk of the water board shall col- lect all water taxes, and receipt therefor, and shall notify all consumers of water in.due time when said vaxes are due and payable, and ‘keep a record of all users of city water in ‘a_book or record for that purpose pro- |, vided by the city council, and shall receive as salary and compensation for such service such sum in addition to his salary as city clerk as the council may direct. (D) There may be appointed by the city council an engineer, who may be required to perform the duties of superintendent'in addi- tion to those of engineer. He shall when ap- | pointed be prepared for duty at all times and have charge of the engines, pump and ma- chine shop and the care and supervision of all machinery connected with the water works, he shall visit and examine all hy- drants in the city at least once a month and shall not leave the city without the consent of the city council, or the mayor. given writing, but in no case until a substitute shall be obtained, who shall be a competent and regularly licensed engineer. and who shall be paid by the engineer out of his own salary. 5 The salary of the city engineer, when ap- pointed, shall be fixed by the city council. in the same manner as other appointive ofticers, and he may be required to give a bond in a sum not less than £1000.0v for the faithful per- formance of his duties. | Sccuion 0.
