A friendly suit to test the law relating to the introduction of li- quor on the Indian reservation was brought before United States Commissioner DeLury at Walker Monday and will probably be carried to the supreme cours for final decision. It is desired to have an opinion as to the rights of a purchaser of a deceased In- dian’s land in Indian territory which have been sold and trans- ferred with the approval of the secretary of the interior accord- ing to the law governing such transaction. The defendant in the caseis Hugh Funk, who'was on a tract of land about a mile and a half from Ball Club and who was ar- rested on the technical charge of introducing liquor in Indian ter- ritory. At the hearing before Commissioner DeLury he was defended by F. W. Smith of Cass Lake, Mayor Gore:flo of the same village, to whom: the prop- erty was sold by heirs of the de- ceased Indian, appearing as a witness. Cheated Death.
