MURDER IN THE FIRST DEGREE " Jury in Chounard Murder Trial Returns Verdict This Morning. DGE SPOONER PASSES . SEN- TENCE AT SIX TONIGHT. Man Who Murdered His Wife While Intoxicated May % Hang for Crime. A 4 The jury in the Chounard mur- —der case, which-has-been before the district court at Walker dur- ing all of this week, returned a verdict of murder in the first de- gree at 8 o’clock this morning after being out for ecighteen hours. Chounard and his attorney, A. T, Larson, of Brainerd, were present when the verdict was _announced, The defendant bore up well. He had pleaded mental “irresponsibility caused by exces- sive drinking“and while he did not expect acquittal he and his attorneys had hoped for a yer- dict inthe second degree and after the jury had remained out until last mght a disagreement was considered as a possibility. Judge Spooner aanounced that he would pass sentence at six o'clock this evening. The crime of which Chounard is.convicted was committed at Cass Lake last Janaary. Chounard quarreled with his wife, Dora Chounard, in a house of ill fame, and fatally shot her. 'He was in a state of beastly intoxication at the time, put has’ little sympathy from those who are familiar with all the circumstances. Manager Lycan, of the Crooks- midji fan that this city can have all the league gamesit-wants this season; The matter of arranging the games in_this city was dele: gated to Mr. Lycan by the leaguc ofiicials and for a time there was some doubt as to how much b: ball might be expected here this season from the northeérn league. Cass Lalke was anxious for some of the games, but as Bemidji has an established record for patron- age its claims were first cons ered. It is probable that a series of eight games will b nged for this city. The games will be played during the convention of the Liquor Dealers and on the dates of the several excursion which will be brought to thi during the summer months. HAVE AN OPTION Masonic Lodge Has an Option on Valuable Third Street Prop: erty for Ten Days. A deal was made yesterday morning by which sthe local Ma- sonic lodge through’ its - repre- sentatives acquired an option on the building on Third strect oc- cupied by Matheny’s billiard hall for ten days at a price of $3,500. The Masonic lodge together with the 0dd Fellows and Knights of Pythias have been contemplating the purchase of property in the business section of the city with the ultimate end of building a fraternity hall. It is believed that the sale will be made under the conditions of the option. Waldon Dissmissed. A. Waldon, the Nary man changed by Julius Gansoage, of Bemidji, with the abduction of his daughter, was arraigned in Judge Reynolds court this morn- ing, The charge formally pre ferred against him was the ab- duction of a minor female person. The girl testitied that she was over sixteen years of age and Waldon was dismissed from cus: tody by the court. THREE PRINCIPAL AVENUES MAY-BE-BOULEVARDED. Would Reduce the Cost of Paving in the Future and Makes Good Appearance. Property owners on Bemidji, Minnesota and Beltrami avenues are engaged in an interesting dis- cussion as to whether or not it would be advisable to boulevard Il three avenues from Fifth| treet north, and at this time, when many improvements are being contemplated to the city streets, the time to settle the question definitely is-believed to be at hand 1f Bemidji’s growthin the past five years may be taken as a criterion of the progress which it will make during the next five one of théfimprovements that will bo witnessed in that time will be the paving of the streets of the city. The expense of paving will fall upon the property owners and the boulevard plan offers the inducement of decreased expense in paving. 3 A boulevarded street is one on which a grass plot extends from the sidewalk to the curb. It may be of various widths, according to the prevailing dewand, In many of the newer cities in the west. boulevarded streets have been constructed during the past twenty years. They give a very pleasing appearance to any city and the only question is whether or not the plan is agreed on by all the property owners. Late last fall there was a peti- tion before the city council ask- ing that Bemidjiavenue be boule- varded from Fifth street north. No action was taken in the mat- ter as the petition came too late in the season to require immedi- ate attention and the various members of the council desired the possibility of their authority being relegated to other shoul ders before the time came for action, Many think that a boulevarded ct is the proper thing in the residence portion of the city. Still others, who are planting ade trees, i making other othe streets be- s find that if were to establish a rd it would wmake them some inconvenience. They do not think the time is. near when paving will be considered. Those who take long looks ahead and sec-in-the-fntnre Bemidji-a - city (00 people think the proper o-establish-the—metes—and bounds of the strects with refer- ence to boulevards is now, and Ppetitions are to be prepared and circulated among the property owners on all three avenues ask- ing the city council to boulevard them. The fire - which started early yesterday morning in the Hartley block destroyed the greater part of the business portion of the: town, causing a loss which -is - estimated at $150,000. Among the buildings burned and the individual losses ave: Hartley block, loss, $25,000, in- surance, ‘$8000; Wise building, loss, $10,000. insurance, $8000; Stipp Bros., hardware, loss, £15,000, insurance, $8000; R.
