o 9 INQUESTWASHELD LAST NIGHT Coroner’s Jury Finds F.J. Artz Guilty of Felonious Homicide. PRELIMINARY HEARINGSET FOR THURSDAY-OF THIS WEEK: - Body of Weilander Will be Inter- red at Greenwood Cemetery today. tested his claim, off the place at the muzzle of a rifle. The testimony of all the wit- nesses was to the effect that Artz had first discharged his rifle in the air and that Weilander had drawn a revolver and discharged it at Artzand that the latter had then fired the fatal shot. The preliminary hearing is set before Judge Reynolds on Thurs- day of this week and at this time the testimony. of other withesses will be taken. Artz will not waive examination at- the preliminary hearing: = = The body of Weilander which has been kept at the undertaking rooms of J. P. Lahr since yoster- day afternoon was interred The juryof the coroner’s in- quest held at the court house last night to inyestigate the killing of Peter| Weilander, the Battle homesteader found F.J. Artz, who did the shooting guilty of felonious homicide. The coroner’s jury was com- posed of W. W. Hartman, George Gill, E. A. Schneider,- P. Covell, M. E. Thurston and J. F. Essler. The jury returned the following verdict, ‘‘Said Peter Weilander came to his death on the 8th day ~of April; 1904 at said county of Beltrami by the means of a gun shot wound from a riffe in the hands of F. J. Artz, that said - shot was fired by said Artz at said Weilander with intent of in- jurying said Weilander, that there was no lawful excuse or _ justifications for said Killing, that said shooting occurred on the 8th day of April, 1904 and that said F. J. Artz is guilty of felonious homicide. ” The witnesses examined were Andrew Dahlmen, John C. Rust, F. A. Gabriel, C. A. Bergland, Ole Olson, John A. Carlson, J. O. Johnson, and L. O. Rask, home- steaders from the Battle country and Dr. E. H. Marcum, who con- ducted the autopsy. Complaints of petit thefts from the stores of the city have been quite frequent of late and the officers are on the lookout for the kleptomaniac. One week ago_last night a stranger drove up to the livery barn of Wm. Bagley and secured stabling for a team of draught horses. Since that time he has notreturned to look after his property and the most diligent search made yesterday fails to reveal any clue to his where- abouts. The corres- pondence continued and the pair exchanged photographs. Finally| the meeting at the woman’s home was arranged. The meet- ing ‘was' mutually satisfactory and the wedding occurred a few days later. Rocky Road to Ripple:~ Ole Stai, a homesteader from today. Mr. Stai came out to transact some business before the winter road became impas- sable for foot travel. He walked the distance of 40 miles from Ripple to Northome and says the road is in a terrible condition and it will be well nigh impossible to use it'under any circumstances by-the-latter-part-of-this-week:— Presents An 0ld Claim. Attorney Sullivan, of St. Cloud, this morning appeared before Judge Clark, of the county pro- bate court for J. P. Coates, whose the Ripple country is in the city|. claim against the Street estate, is contested by the administrator J. F. Gibbons. “The Coates claim is a note for $200 made some time ago. The court is expected to make a decision in the matter some time day. Tried a Get-Away. A prisoner taken into custody by Patrolman Cline about md- night last night tried a get-away at the door of the city jail. While Mr. Cline was fumbling for the keys in his pocket the prisoner tools to his heels. Mr. Cline soon overtook him and landed him safely in thelockup--Mr: Cline is something of o sprinter himself and doesn’t object to a:xcasonable handicap. LIBRARY OPENING Will Occur Thursday Evening At the Court House--Miss Baldwin Will be Here. Miss Clara Baldwin, of the state library commission will ar- rive'in Bemidji tomorrow even- ing—to-assist the'Ladies Library Association in opening the new public library for general use. It has been decided to have a public opening at the court house Thursday evening. The| meeting will be held in the court room and it is hoped to have a full attendance from the people of the city. Miss Baldwin will be present and will address the meeting upon the subject of pub- lic libraries in general. Sheisa pleasing speaker and is excep- tionally well posted in these matters and her address will be a very interesting one. An opportunity will be given Thursday evening to inspect the library and its quarters at the court house. Was Not Judge Pendergast. Yesterday’s Pioneer stated that a women had been sentenced to pay a fine in Judge Pender- gast court for a theft committed dt Schroeder’s store. The case did not have a hearing in Judge Pendergast’s court and Judge Reynolds heard it. Judge Pen- dergast had no connection with the matter. _An Ad That Brought Results. PENMAN PINCHED Edward 0’Brein Accused of Forg- ery Arrested Late Last Night. Edward O'Brein, recently em- ployed asa clerk by the Solway Mercantile Company was arrest- ed late last night charged with having forged several drafts and secured payment on them at various places in this city. James Thurston proprietor of the Hub saloon paid two for $50 each and Ole Gennes, John Larson and Wm. Welch also cashed drafts for like amounts. O’Brein was arrested late last night by Patrol- man John Cline. This morning he was before Judge Reynolds and pleaded not guilty to. the charge. He stated that he could establish the paper he had passed as being all rightand an adjourn- ment was' taken for ten days. He was releas 2d under $1,000 WANTS PUBLICITY City Recorder Bailey Believes Council Proceedings Should Be Printed. The Beltrami County News, the |official paper of the village will hereafter print the proceed- ings- of the city council in their official form as prepared by Re- corder Bailey. The law does not require that the council proceedings shall be published but in every town and village of the state of any im- portance the proceedings of the council are published neverthe- less, the idea being that the official acts of the council should be open for the nspection of the people at large. However, since the council en- tered upon its present term the proceedings have not been pub- lished. Mr. Bailey has always been a friend of the local 'newspaper and his action in championing the rights of the publishers since the matter has been up for. con- sideration is * appreciated by. every newspaper man in the city.
